By booking through www.helloVietnam.com, you have understood and agreed with the following terms and conditions. References to “us”, “we”, “our”, and/or “helloVietnam” in these booking terms and conditions shall mean helloVietnam Company Limited (Enterprise code: 0107868462, address: 2nd Flr., 302 Nguyen Trai St., Trung Van Wd., Nam Tu Liem Dist., Hanoi, Vietnam).
Bookings must be secured by a deposit of a minimum of 30% of the total booking value, or US$150 for bookings of value US$500 or below, via our secure online payment system or bank transfer. We accept major credit/debit cards: VISA, MasterCard, JCB (Please note that there is an additional 3% transaction charge levied for using this payment option). This deposit is non-refundable unless we cancel your tour. Tour balance will be settled when you arrive in Vietnam by cash or credit/debit card (with additional 3% transaction charge). In case you make the balance payment by bank transfer, it is required that you wire the transfer 2 weeks before your arrival date and send us the bank slip copy.
In some special cases, a bigger deposit amount and/or a sooner due date to make balance payment will be required for certain third party- provided services (such as flights, some cruises etc.). You will be notified such information before making the booking, otherwise, the above deposit terms are applied.
All prices of the services and tours on our website are in United States Dollars ($). Please note that prices quoted are subject to change, and will only be secured once we receive necessary deposit. No refunds or exchanges will be made in respect of accommodation, meals, activities, transport or any other services which are included in the tour price but, for whatever reason, are not utilized by you.
All cancelations must be received in writing. Cancellations made by you will apply the following rules:
We will make every effort to operate all tours as proposed however due to external factors which are out of our control, alternative accommodation and services may be arranged when needed. We therefore reserve the right to modify or cancel any tour, accommodation or services at any time. We will notify you as soon as possible of any changes, and will arrange on your behalf one of the three following alternatives:
Vietnam was ranked the third safest travel destination in Southeast Asia according to World Economic Forum. Moreover, helloVietnam will try our best to select reliable suppliers and ensure your safety. However, having a travel insurance plan for your trip is still highly recommended to protect you from unexpected incidents which may happen during your travel. Your insurance should cover trip cancellation and interruption, medical protection, loss of baggage and personal blongings, and accidental death. In some cases, helloVietnam may ask you to provide evidence of such insurances.
International airfares to and from Vietnam, early/late check-ins to hotels, some meals, gratuities, personal expenses are excluded from the tour price unless they are specifically stated in your itinerary. In case you need any extra services, our travel consultants will be more than happy to provide you additional quotes accordingly.
Please note that some suppliers may impose additional fees for infants and children. These will be advised at time of booking.
If you have any special requests or needs (for instance: disability access, special diet or allergy, room with bathtub or walk-in shower etc.), it is advisable that you inform us at the time of making your booking. We will try our best to alter to your needs, however, we cannot guarantee the availability of every requirement. We make no promises and take no responsibility for special requests which are unable to fulfill. We also reserve the right to decline the booking that we are unable to satisfactorily accommodate.
Please consult with your local doctor, travel medical service or specialist vaccination clinic before traveling to our region, and make sure you are fit to travel. If you are under specific medications, please carry enough amount with you because some medications are difficult to get in Vietnam. One tip is that you should keep your daily and/or important medications with you in hand-carry luggage instead of check-in luggage in case of airlines misplace or lose your check-in luggage (which happens occasionally).
Please check your travel documentation to make sure visa has been obtained, all the information and dates are correct, your passports have at least six-month validity and 2 blank pages per each country you are entering. Make sure you carefully read the invoice and other documents sent by us to you as soon as you receive them and immediately contact us if any information is incorrect. If you do not arrive on the agreed date for your tour, we may treat the tour as having been canceled by you.
All travelers must follow our instructions and conduct in a proper manner at all time. We take no responsibility for any of your loss or injury suffered as a result of failing to comply with our instructions, or for any damages you cause to our or any third party’s property. You indemnify us for all third party actions which are taken against us for loss or damage caused by you or arising from your participation on the tour. You agree to take responsibility for any loss or damage sustained by you arising from or in relation to your contravention of any law of any place while you are on tour.
In case you are not satisfied with any aspect of the services we have organized on your behalf, it is advisable that you report it to your tour guide immediately so that necessary action can be taken shortly to remedy the problem. Any feedback made to helloVietnam following the conclusion of the tour should be made in writing within 14 days of completion of the tour. If you do not notify us in writing within this amount of time, our ability to investigate may be prejudiced.
We occasionally take photos and/or videos while you are on tour for use in promotional material. If you don’t advise us otherwise, you consent to such use of photographs and/or videos.
Certain third party-provided services (including flights, transportations), hotels, meals and certain tour activities are arranged by us on your behalf as an agent only. We are responsible for selecting reputable service providers, however, we have no control over, or liability for, the services provided by third parties. All bookings are made subject to the terms and conditions imposed by these service providers which we can provide you on request. Your legal rights in relation to such services are against the specific service provider and, except to the extent a problem is caused by a fault on our part, not against us. You acknowledge that this clause shall apply to all third party-provided services notwithstanding that our tour guide may accompany you during provision of such services.
All monies paid by you to us will be our property and will be a debt due and payable to the travel service provider once the services to which the money relates have been provided. You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.
Your booking is accepted on the understanding that you appreciate and assume the risks inherent in travel. These risks may be greater if your tour includes adventure activities or sports (such as kayaking, hiking, climbing, rafting, cycling, and quad or motor biking). To the extent permitted by law, neither helloVietnam nor any of its related bodies corporate, directors, shareholders, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by:
Except in cases of death or bodily injury, our liability is limited in any event to a maximum value of the price of your tour. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such as under applicable consumer laws, our liability is limited to the remedies required of us under those laws.
Subject to these terms and conditions (including ‘Our role as agent’), our liability to you for death or bodily injury, where such death or bodily injury is not caused by or contributed to by you, is limited in accordance with any applicable international conventions, including the Geneva Convention 1973 in respect of carriage by road and the Athens Convention 1974 in respect of carriage by sea.
If any dispute arises between you and us, the laws of Vietnam will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Vietnam and waive any right that you may have to object to an action being brought in those courts. Any aspect of this agreement which is invalid in any jurisdiction is invalid in that jurisdiction to that extent, without invalidating or affecting the remaining provisions of this agreement or the validity of that provision in any other jurisdiction.
We would also like to store and use your personal data for future marketing purposes (for example, sending you our marketing material) unless you have told us that you do not wish us to do so. All personal data you give us (including sensitive personal data) will be kept but we will use only names and contact details for marketing purposes. If you do not wish to receive any marketing material or communications from us, please e-mail support@helloVietnam.com. We do not sell personal data to any third party.
We take appropriate technical and organizational measures which are intended to prevent unauthorized or unlawful processing of personal data and accidental loss or destruction of, or damage to, personal data.
You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. We promise to respond to your request within 40 days of receiving your written request and fee. In certain limited circumstances, we are entitled to refuse your request.
